ebookmycar Platform Terms and Conditions
ebookmycar.co.za is a division of Hybrid Learning Solutions (PTY) Ltd ("ebookmycar", "we", "us").
1. Acceptance
By registering a service centre account, you confirm that you have the authority to bind the service centre named in this registration ("the Service Centre") to these Terms and Conditions, and to the Service Centre Partner Agreement issued to it separately.
2. The Platform
ebookmycar provides an online booking, service-catalog, invoicing and customer-management platform through which members of the public may discover the Service Centre and book services offered by it. The Service Centre is solely responsible for the accuracy of its listed services, pricing, availability, and for honouring bookings made through the platform.
3. Platform Fee
ebookmycar charges the Service Centre a platform fee of R3.75 (excl. VAT) per non-cancelled booking made through the platform. Fees accrue monthly and are consolidated into a single invoice issued by ebookmycar shortly after the end of each calendar month, covering all non-cancelled bookings completed in that month. Invoices are payable within 14 days of the invoice date. ebookmycar may suspend the Service Centre's access to the platform for accounts that are more than 30 days in arrears.
4. Service Centre Obligations
The Service Centre agrees to: keep its service catalog, pricing, and contact details accurate and current; honour bookings accepted through the platform; issue valid tax invoices to customers for completed work; and treat customer information obtained via the platform as confidential and use it only to fulfil bookings.
5. Data and Privacy
ebookmycar processes customer and booking data on behalf of the Service Centre in order to operate the platform. The Service Centre will not use customer data obtained through ebookmycar for purposes unrelated to fulfilling bookings made through the platform.
6. Term and Termination
This agreement remains in effect until terminated by either party on 30 days' written notice, or immediately by ebookmycar for material breach, including non-payment of platform fees. Fees accrued prior to termination remain payable.
7. Liability
ebookmycar provides the booking platform "as is" and is not a party to the service contract between the Service Centre and its customers. ebookmycar's liability to the Service Centre arising from use of the platform is limited to the platform fees paid by the Service Centre in the three months preceding the claim.
8. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
9. Changes
ebookmycar may update these Terms and Conditions from time to time. Continued use of the platform after notice of a change constitutes acceptance of the updated terms.
